Thank you for visiting The Dingwall Trust website; your access is subject to the following Terms and Conditions. The Dingwall Trust is a registered charitable entity under the Charities Act 2005, registration number CC25017, located at 8 Dingwall Place, Papatoetoe, Auckland 2025.

Please read these terms and conditions carefully. Use of the Site indicates your automatic acceptance. The Dingwall Trust reserves the right to change these terms of use from time to time. You are responsible for reviewing regularly information posted on the Site to obtain timely notice of such changes. The Trust reserves the right at any time to make access to certain materials or services on this website conditional on you agreeing to additional terms of use.

Ownership and Copyright

The content of the Site (Content) is protected by copyright, trade mark and other intellectual property laws.  You  must not modify, copy, reproduce, republish, frame, upload to a third party, transmit or distribute in any way the Content without the prior consent of The Dingwall Trust, except as expressly provided in these Terms and Conditions or as permitted by the Copyright Act.

The Dingwall Trust’s logo and name are trademarks and may not be reproduced or used without express consent of The Trust. Please contact us if you would like to include our logo on your website or other materials.

Access

Access to the Site is freely available to the public. The Trust reserves the right to deny access to, or use of, all or part of the Site without prior notice if behaviour is deemed, at our sole discretion to

  • violate any terms or provision of these Terms and Conditions;
  • violate the rights of The Dingwall Trust or associated third parties, or
  • otherwise be inappropriate for continued access and use of the Site.

System integrity and user conduct

You must not use the Site to:

  • impersonate or otherwise misrepresent your identify or affiliation with any other person or entity;
  • send junk, obscene, indecent, offensive, or threatening electronic mail or ‘spam’ to people who would not wish to receive mail from you;
  • falsify or delete any attributions, legends, or other proprietary designations of origin or source of any Content of the Site;
  • interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site;

Those sites are not under the control of The Trust and The Trust is not responsible for the content or the links contained in those sites, nor is it responsible for or endorses any products or services of third party organisations mentioned or described in or linked to this Site. Your use of these third party sites, and any resultant transactions, may be subject to separate terms and conditions. If you choose to acquire goods or use a service linked to this Site, you do so at your own judgement and risk.

Use of information

The information provided on this Site is not intended to offer advice or recommendation. Any information related to social care of vulnerable children is prepared for the general information of the users of the Site.

Donation terms and conditions

All donations $5 and over are tax deductible and are receipted to the individual or company making the donation. The donor may be entitled to a tax rebate for their donation at the end of the financial year. Visit www.ird.govt.nz/income-tax-individual/tax-credits/donations-taxcredits for more information.

All donations are in New Zealand dollars.

Receipts will not be given for non-cash contributions although we can provide confirmation that an in-kind contribution has been made.

Donations are voluntarily given and generally will not be refunded, unless in the event of funds given for an expressed specific purpose, agreed with the Trust at the time of donation, that has not been fulfilled by The Trust. Any refunds are at the discretion of the Chief Executive of The Dingwall Trust.

The Trust will refund all donations made through the fraudulent or unauthorised use of a credit card or where debits have been taken from a donor’s bank account or credit card that have not been authorised by the donor.

Data Protection

Although every effort is made to ensure the security of the Site and to protect any information on it, any data including personal information that you provide to The Dingwall Trust via this Site cannot be guaranteed to be totally secure. Accordingly, any information you supply to us via the Site, such as on a contact form, is given at your own risk.

Once the information has been received, we will ensure all data held by us is secure and confidential. Please refer to our Privacy Policy for more information on the collection, use, disclosure and security of your personal data for The Trust. The Dingwall Trust adheres to the Privacy Act 2020.

The Dingwall Trust processes credit cards via a secure, PCI DDS-compliant credit card gateway. Customer’s payment details are encrypted into a single token that is stored on our payment gateway’s secure server. The Dingwall Trust does not store credit card information collected online.  For more information, please refer to our privacy policy.

Liability

The Dingwall Trust tries to ensure all information on the Site is correct. Although we have made a conscientious effort to provide high quality information, The Trust disclaims any implied guaranteed of the accuracy of any information.

We accept no liability for any failure to comply with these terms and conditions where such failure is due to circumstances beyond our reasonable control.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision shall be enforced to the maximum extend possible and will be deemed deleted to the extent that it is not enforceable. All remaining provisions of the Terms & Conditions shall remain in full force and effect.

In addition, any research, news, opinion, commentary or other item mentioned or included in this Site is not necessarily intended to imply endorsement or approval by The Trust.

This does not affect your statutory or other legal rights as granted under the laws of New Zealand.

General

These Terms and Conditions are governed by the laws of New Zealand and construed in accordance with the laws of New Zealand. Disputes arising from these Terms and Conditions will be exclusively subject to the jurisdiction of the courts of New Zealand.

If you do not accept these Terms and Conditions in full, you do not have permission to access to contents of the Site and should cease using the Site immediately.
